Construction defect claims are wrought with minefields for both coverage and defense. On the one hand, coverage questions in defect claims require careful navigation to obtain the information to evaluate the carrier’s indemnity obligations without running afoul of an insured’s right to a defense. On the other hand, defense attorneys must provide a zealous defense without overtly revealing facts defeating coverage for their client/insured. Thus, the minefield.
